Abstract

The topic of this paper is an article of N. P. Gratsiansky on economics and agrarian law in Ancient Rome. It contrasted sharply with the issues of the Soviet historiography that developed on the ground of the Marxist-Leninist conception. The authors concluded that this article of N. P. Gratsiansky not only corresponded to the level of development of the European scholarship but was ahead of it on some aspects of research of Roman agrarian structure in the year 1940. Thus N. P. Gratsiansky criticized sharply the conception of M. Weber on dependence of the ways of land surveying on the legal status of this land. He proved convincingly that Romans had selected the way to divide the land depending on the topography and in accordance with the convenience of this or that technical solution. N. P. Gratsiansky examined carefully the conception of an well-known specialist on the Early Middle Ages A. Dopsch who had guessed that the chaotic patchwork of land plots of the Germanic tribes had been a heritage of the patchwork of Roman land surveying. N. P. Gratsiansky shed some light both on the theory and the practice of dividing of land plots in Ancient Rome. This dividing was aimed to the establishment of a connection with market by the use of ways-dividers what had helped develop of Roman agrarian structure. N. P. Gratsiansky opened for Soviet scholarship the possibility of the further research of not only the economic base but also of the legal status of all the Roman land types and categories.
