Abstract

The author of this article focuses on the problem of correlation and interaction in the management sphere of the medieval political theories, which were created by the efforts of the legists together with the Crown, and Customary Law, which was an integral and basic part of the Law of this period. The author shows on the material of the Aragonese royal documentation, that was composed in the curia in response to the petitions of the Muslim subjects of the Crown, that the idea of Justitia was accumulated in the practice of political management through its conjunction with Customs. This phenomenon was largely due to the fact that the “public” demanded support of the “common”, accepted as some habitual by the people. This point of view was determined by the texts of Roman law, on which medieval jurists relied. It is equally important that the idea of Justitia was embodied in the communicative practice, which existed between Society and Authority, despite the fact that both the power and the subjects referred to Customs within the framework of their legal interaction.
