Abstract
Ecclesia privata is the widespread phenomena in the structure of early ecclesiastic organization. Though there are only a few studies dealing with it. To my mind this absence of specific interest to ecclesia privata in traditional medieval studies can only be explained if we understand that, from the point of view of the history of spiritual life of the society, private church is a very common religious institution that does not differ in its functions from the bishopric or royal churches. It has other main peculiarity: the origin of the private churches is deeply connected with the formation of large land property in Late Antiquity and Early Middle Ages so all its existence is regulated with the private law and the contract and not with the cannon law as we could expect. That is why the questions about the status of the priest in these churches, the right to the revenues from the church’s tenure, the influence of the private property had to the disciplina ecclesiastica generally are very important. But it is difficult to answer them because there is “reality” beside the law regulations of the private church that is very often not the same. The author does not try here to discuss all of abovementioned problems but deals with the key conceptions, necessary for understanding of the relations of property and power concerning the private church.
